Welcome to Boomer Gifts. These Terms of Service ("Terms") govern your use of boomergifts.com (the "Site") and your purchases from our store. By using the Site or placing an order, you agree to these Terms. We have kept them as plain as possible; please read them before you order.
1. Who We Are
Boomer Gifts is the trading name of Khawar Hassan Saeed, a sole trader based in England, United Kingdom ("Boomer Gifts", "we", "us", "our"). When you place an order on the Site, you are contracting with Khawar Hassan Saeed trading as Boomer Gifts.

We design and sell made-to-order gifts, many of which can be personalized. Our products are produced and shipped by production partners in the United States. We currently sell and ship within the United States and Canada only.
You must be at least 18 years old, or the age of majority where you live, to make a purchase.
2. Orders and Acceptance
When you place an order, you will receive an order confirmation email. This confirms that we have received your order; it does not necessarily mean that your order has entered production.
Your order is accepted when it enters production.
We may refuse or cancel an order where, for example, we suspect fraud, there is a pricing or product-description error, an item becomes unavailable, or personalization content breaches Section 5 of these Terms. If we cancel an order that you have already paid for, we will issue a full refund.
3. Pricing and Payment
All prices are shown in US dollars. Shipping costs are displayed at checkout before you complete your purchase.
We work to keep our pricing and product information accurate, but errors may occasionally occur. If an item's correct price is higher than the price displayed when you placed your order, we may contact you before proceeding or cancel the order and issue a full refund.
Payment is taken at checkout through our supported payment providers, which may include Shopify Payments, PayPal, Apple Pay, Google Pay, and Shop Pay. We do not store your full payment card details.
Orders shipped to Canada may be subject to import duties, taxes, customs fees, or other charges assessed upon delivery. These charges are determined by Canadian authorities or the shipping carrier, are not included in your order total, and are the responsibility of the recipient.
4. Made-to-Order Products, Changes, and Cancellations
Every product is made to order after you place your order. Production typically takes approximately 2 to 3 business days, followed by shipping. Delivery estimates and additional shipping information are provided in our Shipping Policy, which forms part of these Terms.
Because production begins quickly, orders may only be canceled or changed within 1 hour of purchase and before they enter production, whichever comes first.
If you notice an error in your personalization, need to correct your shipping address, or want to request a cancellation, contact us as soon as possible at support@boomergifts.com. Where available, you may also use the cancellation option in your customer account.
Once the 1-hour cancellation window has passed or your order has entered production, it can no longer be canceled. Changes may also no longer be possible once production has started.
You are responsible for reviewing your order details, shipping address, product options, size, color, and personalization information before completing your purchase.
5. Personalization Content
Many of our products allow you to enter names, dates, messages, or other text, or upload photos and other content. You are responsible for the content you submit.
By submitting personalization content, you confirm that:
- You have the right to use the names, words, phrases, photographs, images, and other content you submit.
- Your content does not infringe any trademark, copyright, privacy, publicity, or other rights belonging to another person or organization.
- Your content is not hateful, harassing, defamatory, unlawful, or otherwise prohibited.
We may refuse, cancel, and refund an order if its personalization content breaches these requirements.
Personalized products are produced using the information submitted with your order. Please carefully check names, dates, spelling, capitalization, photos, messages, sizes, colors, and other personalization details before completing your purchase.
By uploading a photo or other content, you grant us a limited license to reproduce and process that content solely as necessary to produce, fulfill, and ship your order. We do not use customer photos for marketing without separate permission.
6. Product Representations
We do our best to display product colors, sizes, materials, designs, and other details accurately. However, colors can vary between screens, and slight differences in color, placement, alignment, or finish may occur during made-to-order production.
Minor variations that are normal to the production process are not considered defects.
Where an image is an illustration, digital rendering, or design mock-up rather than a photograph of the finished product, we aim to make this clear on the applicable product page.
Genuine defects, shipping damage, incorrect products, and items that are materially different from what you ordered are covered by our Returns & Refund Policy.
7. Returns, Replacements, Refunds, and Exchanges
All products are final sale for change-of-mind purposes. We do not accept returns or exchanges because you changed your mind, no longer need the product, ordered the wrong item, selected the wrong size or option, or provided incorrect personalization information.
This rule applies to both personalized and non-personalized products.
If your order arrives damaged, defective, incorrect, or materially different from what you ordered, contact us within 30 days of delivery at support@boomergifts.com.
Please provide your order number, a clear photo showing the issue, and a brief description of the problem.
Once the issue is verified, we will provide a free replacement or a full refund, as appropriate.
You will normally not be required to return a damaged, defective, or incorrect item. If a return is required in a particular case, we will provide return instructions and cover the applicable return shipping cost.
We do not offer exchanges.

8. Reviews and Customer Content
If you leave a review or send us a photo, message, testimonial, or other feedback about your order, you give us permission to display that content on the Site and in our marketing, together with your first name and general location where appropriate.
We do not edit reviews except where necessary to remove personal data, unlawful content, or content that violates our policies. We do not offer payment or incentives in exchange for positive reviews.
You may ask us to remove content you submitted for review or marketing purposes by contacting support@boomergifts.com.
9. Intellectual Property
All content on the Site, including text, product designs, descriptions, images, logos, graphics, and layout, belongs to Boomer Gifts or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, or use our content for commercial purposes without our prior written permission.
Names, photographs, text, and other content that you provide for personalization remain yours or the property of their respective rights holders.
10. Acceptable Use of the Site
You agree not to use the Site for any unlawful purpose, interfere with its operation, attempt to gain unauthorized access to any system, transmit harmful code, or scrape or harvest data from the Site without authorization.
11. Privacy
Our Privacy Policy explains what personal information we collect, how we use it, and your applicable privacy rights.

12. Disclaimer and Limitation of Liability
The Site and our products are provided subject to the rights and protections that apply under applicable law.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, or consequential losses arising from your use of the Site or our products.
To the maximum extent permitted by law, our total liability for a claim relating to an order will not exceed the amount you paid for that order.
Nothing in these Terms limits or excludes any rights or remedies that cannot legally be limited or excluded, including mandatory consumer rights that apply where you live.
13. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold us harmless from claims, losses, liabilities, or expenses arising from your breach of these Terms, including claims resulting from personalization content you submit in breach of Section 5.
14. Governing Law
These Terms are governed by the laws of England and Wales.
Nothing in this section deprives you of mandatory consumer protections that apply under the laws of the place where you live, or any right you may have to bring a claim in your local courts where applicable law permits.
15. Changes to These Terms
We may update these Terms from time to time. The version posted on this page, together with its "Last updated" date, will apply to orders placed after that version takes effect.
