Welcome to Boomer Gifts. These Terms of Service ("Terms") govern your use of boomergifts.com and your purchases from our store. By using the site or placing an order, you agree to these Terms. Please read them, we have kept them as plain as possible.

1. Our Store

Boomer Gifts is a United Kingdom based business selling made-to-order and personalized gifts. All products are produced and shipped by our production partners in the United States, and we currently sell and ship within the United States only. You must be at least 18 years old, or the age of majority where you live, to make a purchase.

2. Orders and Acceptance

When you place an order, you will receive an order confirmation email. This confirms we received your order, not that it has been accepted. We reserve the right to refuse or cancel any order, for example in cases of suspected fraud, pricing or product description errors, or personalization content that violates Section 4. If we cancel an order you have paid for, we will refund you in full.

3. Pricing and Payment

All prices are in US dollars. We work hard to keep pricing accurate, but errors can happen. If an item's correct price is higher than the price displayed at the time of your order, we will contact you before proceeding or cancel and refund the order. Payment is processed securely at checkout through our supported payment providers.

4. Personalization Content

Many of our products let you enter custom text. You are responsible for the content you submit. By entering personalization text, you confirm that:

You have the right to use the names, words, or phrases you submit
Your text does not infringe any trademark, copyright, or other intellectual property rights
Your text is not hateful, harassing, defamatory, or unlawful

We reserve the right to cancel and refund any order whose personalization violates these rules. Personalized items are produced exactly as the text is entered, including spelling and capitalization, so please review your text carefully before ordering.

5. Shipping, Returns, and Cancellations

Delivery timelines, order changes, and cancellations are governed by our Shipping Policy. Returns, replacements, and refunds are governed by our Return and Refund Policy. Both are linked in the footer of this site and form part of these Terms.

6. Product Representations

We do our best to display product colors, sizes, and details accurately. Screens vary, and slight variations in color or placement can occur in made-to-order production. Such minor variations are not defects. Genuine defects and damage are covered by our Return and Refund Policy.

7. Intellectual Property

All content on this site, including text, product descriptions, images, logos, and design, is the property of Boomer Gifts or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, or use it for commercial purposes without our written permission.

8. Prohibited Use

You agree not to use the site for any unlawful purpose, to interfere with the site's operation, to attempt to gain unauthorized access to any systems, or to scrape or harvest data from the site.

9. Disclaimer and Limitation of Liability

The site and its products are provided "as is" to the fullest extent permitted by law. To the maximum extent permitted by applicable law, Boomer Gifts will not be liable for any indirect, incidental, or consequential damages arising from your use of the site or products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Nothing in these Terms limits rights you have under applicable law that cannot be waived, including any statutory consumer rights that apply to you.

10. Indemnification

You agree to indemnify and hold Boomer Gifts harmless from claims arising out of your breach of these Terms, including personalization content you submit in violation of Section 4.

11. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Nothing in this section deprives you of any mandatory consumer protections that apply under the laws of the place where you live.

12. Changes to These Terms

We may update these Terms from time to time. The version posted on this page, with its "Last updated" date, applies to all orders placed after that date.
